加拿大不像美国用 183 天 test,而是看”重大关联”(significant residential ties)——房子、家人、个人物品、车、信用卡、医保都算。从你成为加拿大税务居民那天起,全球收入要在加拿大申报。同时美国仍然按公民 / 绿卡身份对你全球收入征税——美加税收协定(Article XV / XXIV / XXV)通过外税抵免避免双重征税。Canada does not use a 183-day test like the US — it uses “significant residential ties” (home, spouse, kids, personal property, vehicles, credit cards, health insurance). Worldwide income becomes Canada-reportable from the day you become a Canadian tax resident. Meanwhile the US continues to tax you on worldwide income by citizenship/green-card. The US-Canada Tax Treaty (Articles XV / XXIV / XXV) avoids double taxation through foreign tax credits.
14.2 ⚠️ PFIC 陷阱 · 美籍持加拿大 TFSA / Mutual Fund14.2 ⚠️ PFIC Trap — US persons holding Canadian TFSA / Mutual Funds
这是美→加跨境最贵的一个坑。任何美国公民或绿卡持有人,不要在加拿大 TFSA 里持有加拿大注册的 mutual fund 或 ETF——它们在美国 IRS 眼里是 PFIC(Passive Foreign Investment Company),按 PFIC 规则申报(Form 8621)极复杂,且税率可能高至 39.6% + 利息惩罚。The single most expensive mistake in US→CA relocation. Any US citizen or green-card holder: do not hold Canadian-domiciled mutual funds or ETFs inside a TFSA. IRS classifies these as PFICs (Passive Foreign Investment Companies), subject to Form 8621 reporting — punitive (potentially 39.6%+ with interest), and the compliance cost alone runs into the thousands.
解法:TFSA 只持有美国上市 ETF(如 VTI、SPY,不是加拿大版的 VFV / XIC)+ 加拿大个股。RRSP 是协定受保护账户,可以正常买加股、加 ETF,不触发 PFIC。Workaround: Inside TFSA, hold only US-listed ETFs (e.g. VTI, SPY — not Canadian wrappers like VFV / XIC) and individual Canadian stocks. RRSP is treaty-protected, so Canadian ETFs are fine inside it.
14.3 IRS Form 8938 + FBAR · 加拿大账户海外申报14.3 IRS Form 8938 + FBAR — Foreign account reporting
美国公民 / 绿卡持有人持有加拿大账户超过 $50K(个人)或 $100K(共同)需 Form 8938(与税表一起)。FBAR / FinCEN 114 起报门槛更低——年内任何时刻所有海外账户合计超过 $10K USD 即触发,独立申报。漏报罚款重——故意漏报每次最高 $129K + 刑责。US citizens / green-card holders with Canadian account aggregates over $50K (single) or $100K (joint) must file Form 8938 with their tax return. FBAR / FinCEN 114 threshold is lower — any moment in the year when foreign accounts aggregate over $10K USD triggers, filed separately. Penalties for non-filing are severe — willful failure runs up to $129K per occurrence plus criminal exposure.
14.4 RRSP · 美加税收协定 Article XVIII14.4 RRSP — US-Canada Treaty Article XVIII
Article XVIII 让美国公民持加拿大 RRSP 不需要每年申报 RRSP 内部收益——只在提现时美方征税(同时加方预扣 25% / 15% 美籍可申退)。2014 年起 IRS 自动延税,不再需要 Form 8891。即使如此,账户资产本身仍要在 8938 / FBAR 申报。Article XVIII allows US persons to defer US tax on RRSP internal growth — only taxed on withdrawal (with Canada withholding 25% / 15% reduced rate for US persons, which may be claimed back). Automatic deferral since 2014; Form 8891 no longer required. Account holdings still need 8938 / FBAR disclosure.
14.5 Form 8854 · 放弃美籍 / 长期绿卡的退籍税14.5 Form 8854 — Expatriation Tax if renouncing
放弃美国公民身份或长期持有绿卡(持有 8 年内 5 年)退出绿卡,若净资产超 $2M 或前 5 年平均美税 > $206K(2026 数)即为 covered expatriate,按”mark-to-market”视同变现所有资产,资本利得超 $866K(2026 数)部分征 23.8%。退籍前的资产 / 账户规划极度复杂,绝对要在动作前 12-24 个月找跨境税务师。Renouncing US citizenship or surrendering a long-term green card (held 8 of last 15 years) triggers expatriation tax if you are a “covered expatriate” — net worth ≥ $2M or 5-year average US tax > $206K (2026 figures). Treated as mark-to-market sale of all assets; capital gains above the $866K (2026) exclusion taxed at 23.8%. Asset / account positioning needs 12–24 months of pre-planning with a cross-border specialist. Do not DIY this.
