Living With Your Landlord — What Tenants Need to Know

What this means in practice:
· Rent control does not apply — the landlord can increase rent by any amount upon renewal
· The landlord is not required to use the Landlord and Tenant Board (LTB) process to end your tenancy
· You cannot file an LTB application for most standard tenant protections (illegal eviction, maintenance, etc.)
However, if your unit has a private entrance and separate kitchen/bathroom (typical basement apartment setup), you likely do fall under the full RTA — significantly stronger protections.
First thing to do before signing anything: confirm which category your arrangement falls into.
Utilities (hydro, gas, water), internet, parking, laundry — spell it all out. “It’s included” verbally becomes “I never said that” in a dispute.
② Shared space rules
Kitchen hours, refrigerator sharing or dedicated shelves, living room access, guest policy (can guests visit? can they stay overnight?). These feel awkward to ask — but ask them.
③ Notice period to vacate
Under an RTA-exempt tenancy, your contract terms govern everything. Standard is 30–60 days written notice from either side — get this number in the contract, not just verbally agreed.
④ Deposit rules
Ontario law permits a Last Month’s Rent deposit (maximum one month’s rent). That’s it — no security deposit is legally permitted. If a landlord asks for more, that’s a red flag.
⑤ Move-in condition report
Photograph the room and any shared areas at move-in. Both parties date and sign it. This protects you from unfair deposit deductions when you leave.
Practical protections to put in your contract:
· “Landlord will provide 24 hours’ written notice before entering tenant’s room, except in emergencies.”
· Clarify whether the landlord retains a spare key and under what conditions it may be used.
· If there are security cameras in shared areas, confirm they do not capture your private space.
Keep all important communications in writing — WeChat, email, text. Verbal agreements in shared-living disputes are nearly impossible to prove. A simple “just confirming what we discussed — the kitchen is available until 10pm” message after a conversation creates a paper trail that protects both parties.
Save every rent payment confirmation (e-transfer screenshots, receipts). Document every maintenance request in writing. Photograph issues when they occur. In a living arrangement where formal legal protections are limited, your paper trail is what protects you if a dispute escalates.
Align on lifestyle before moving in: Does the landlord have dietary restrictions that affect shared kitchen use (halal, vegetarian, no seafood)? What are the noise boundaries? What time does the household wake up and go to sleep? Ask directly — it’s less awkward than discovering incompatibilities after you’ve unpacked.
Maintain a professional distance: Friendly but boundaried. Being too distant creates tension; being too close blurs the lines and makes boundary conversations harder when needed.
Address issues early: Small friction that festers becomes big conflict. A dripping faucet, a recurring noise issue, a billing disagreement — address it in writing within a day or two. Waiting weeks to “not make it awkward” usually makes it far more awkward.
Always have a backup plan: Know what your next rental option is before you need it. Having a mental exit strategy means you can navigate day-to-day tensions without desperation — and desperation is what leads to bad decisions in any housing situation.
