What TRESA is, and why it replaced REBBA

TRESA (the Trust in Real Estate Services Act) is Ontario’s core statute governing real estate trading services. On December 1, 2023, its Phase 2 formally replaced the older REBBA 2002, aiming to increase transparency, strengthen consumer protection, and modernize the rules for how deals actually happen today.

RECO: who regulates agents

The Real Estate Council of Ontario (RECO) licenses agents and brokerages, enforces the Code of Ethics, and handles complaints and discipline. Any licensed agent’s registration status can be checked on RECO’s website — the first step for a consumer to verify an agent’s identity.

The updated Code of Ethics

The new code was trimmed from 11 pages to 2 — clearer and with higher standards, focused on three things: integrity, quality of service, and conflicts of interest. Shorter doesn’t mean looser; it actually raises the bar on conduct.

The Open Offer Process

This is one of the changes consumers should know best. Under the reform, if the seller authorizes it in writing, an agent may disclose certain details of competing offers (such as price), excluding the buyers’ personal or identifying information. A seller can choose the traditional sealed-bid approach or the open process — the choice is the seller’s.
