When you sign a Buyer Representation Agreement in Ontario, the choice between designated and brokerage representation affects how protected you are — especially if your agent and the seller’s agent work for the same company.

What are the two representation models under Ontario’s TRESA?

Under TRESA (Trust in Real Estate Services Act), effective December 1, 2023, Ontario buyers signing a Buyer Representation Agreement choose between two models. Brokerage Representation means the entire brokerage — including the Broker of Record and all agents — owes you fiduciary duties. Designated Representation means only your specifically named agent represents your interests; other agents at the same brokerage are held to an objective and impartial standard toward you. According to RECO, this distinction is most significant when agents from the same brokerage represent both parties in a transaction — a scenario called multiple representation.

Step 2: What Is Multiple Representation and Why Does It Matter?

Multiple representation occurs when:

  • Same agent represents both buyer and seller (dual agency) — always requires written consent
  • Under Brokerage Representation: two different agents from the same brokerage represent buyer and seller → triggers multiple representation for the whole brokerage
  • Under Designated Representation: same scenario → does NOT trigger multiple representation — each designated agent continues to fully represent their client
⚠️ What you lose in multiple representation:

When multiple representation is triggered, your agent must become neutral — they cannot give you pricing strategy, tell you how low the seller might go, share the seller’s motivation, or recommend specific negotiation tactics. You retain legal representation, but lose the active advocacy that makes representation valuable.

What’s the difference between designated and brokerage representation?
