The Buyer Representation Agreement (BRA, OREA Form 300) is the formal agency contract between you and the brokerage. Ontario regulations require it before an agent can make an offer on your behalf — but the terms are negotiable. Here’s every clause demystified so you know exactly what you’re signing.
📝 5 Key Clauses of the BRA
1
Term (Duration)
How long you’re committed to this brokerage
The standard term is 3–6 months, but you can negotiate a shorter period — even a single-property showing. During the term, you cannot have another brokerage submit an offer on your behalf. Start with 30–60 days if you’re unsure; extend once you’re confident in the relationship.
2
Property Type & Area
The scope of the agreement
The BRA specifies the type of property and geographic area (e.g., GTA detached homes $700K–$1.2M). Properties outside this scope are not covered by the agreement. If you decide to explore a different city or property type, you can sign a separate agreement or amend the existing one with Form 305.
3
Commission
Who pays, and how much
In most Ontario transactions, the buyer’s agent commission is paid by the seller from the proceeds of the sale — buyers typically pay nothing out of pocket. The BRA specifies what happens if the seller offers less commission than agreed in the BRA. Read this clause carefully to understand any potential out-of-pocket exposure.
4
Agent’s Duties
What the brokerage owes you
Once the BRA is signed, the brokerage owes you legal duties: loyalty (act in your best interest), confidentiality (not reveal your top price to sellers), and full disclosure (inform you of anything material to your decision). This is the biggest benefit — your agent is legally obligated to be on your side.
5
Termination
How to exit the agreement
Form 301 terminates the BRA early; Form 302 transfers it to another agent at the same brokerage; Form 305 amends specific terms like area or duration. Most reputable brokerages will cooperate with a termination request if you’re not satisfied with the service. Confirm the exit process before signing.
💡 Arthur’s Take
A BRA is a protection tool, not a trap. The right agent will walk you through every clause before asking you to sign. If an agent pressures you to sign without explanation, that’s a red flag. I explain every term to my clients before we proceed — that’s the standard of service you deserve.
